Public Offer

Individual Entrepreneur «SIREKEES» (TIN 040502550481, registered at 506 Seifullin Street, office 12, Almaty, Kazakhstan; below - "Provider"), acting under its constitutional documents, publishes this document as an official public offer to an unlimited group of persons to enter into a paid services contract for access to the Sirekees Platform ("Contract") on the terms below.

Full and unconditional acceptance of this offer (entry into the Contract) happens when the Customer pays for the chosen subscription plan.

1. Definitions

  • Platform — the Sirekees software at sirekees.com.
  • Services — providing the Customer with access to Platform features at the level of the chosen plan.
  • Customer — an individual or legal entity that has paid for the subscription.
  • Plan — a feature package with a fixed price per billing period (1 calendar month).
  • Billing period — 1 calendar month from the date of payment or the last auto-renewal.

2. Subject

The Provider undertakes to give the Customer access to the Platform, and the Customer undertakes to pay for it on the terms set in this offer and in the chosen plan.

3. Plans and price

  1. Current plans and prices are published at sirekees.com/billing.
  2. As of the publication date of this offer, the following plans are in effect:
    • "Business" — 1 store, extended features. The price is shown in the plan card in the dashboard.
    • "Business+" — up to 3 stores, extended features, priority support. The price is shown in the plan card.
  3. The Provider can change plan prices with at least 14 calendar days' notice to the Customer. Changes do not apply to a billing period already paid for.

4. Payment terms

  1. Payment is made by bank card through YooKassa (rubles) and Interkassa (tenge, US dollars).
  2. Services start when the payment reaches the Provider's account.
  3. The Customer agrees to auto-charge of the plan amount at the start of every new billing period until the subscription is cancelled.
  4. The Customer can turn off auto-renewal at any time from the dashboard at sirekees.com/billing. The subscription stays active until the end of the billing period already paid for.
  5. If a charge fails, access to extended features is paused until payment is restored.

5. Service term

  1. Services are provided continuously throughout the paid billing period.
  2. If the subscription is active, Services auto-renew for the next billing period.

6. Refunds

  1. Under Article 30 of the Republic of Kazakhstan Consumer Protection Law, a Customer who is an individual may, within 14 calendar days from the date of payment, refuse the Services and request a refund — provided the Services have not been used.
  2. A Service is considered used from the first sign-in by the Customer to the Platform dashboard under the paid plan.
  3. After actual use of the Services begins, no refund is issued for the unused part of the current billing period, unless this offer or the law expressly says otherwise.
  4. If a material, unfixable defect of the Platform is found, the Customer may request a proportionate price reduction or a refund for the unused period.
  5. Refund requests go to help@sirekees.com. Response time — up to 10 business days.

7. Rights and obligations

7.1. The Provider agrees to:

  • Provide the Customer with access to Platform features according to the chosen plan.
  • Keep Platform availability at no less than 99% per month, excluding planned maintenance (announced in advance) and force majeure.
  • Protect Customer data confidentiality as set in the Privacy Policy.
  • Provide technical support via help@sirekees.com.

7.2. The Customer agrees to:

  • Pay for the chosen plan on time.
  • Use the Platform according to the Terms of Service.
  • Not share dashboard access with third parties without the Provider's consent.
  • Report Platform issues and other problems on time.

8. Liability

  1. The parties are liable for non-performance or improper performance under the law of the Republic of Kazakhstan.
  2. If the Platform is unavailable for more than 24 hours in a row due to the Provider's fault, the Customer's billing period is extended by the downtime.
  3. The Provider's total liability is capped at the amount the Customer actually paid for the subscription in the last 12 months.
  4. The Provider is not responsible for the quality of goods and services the Customer sells through their Stores on the Platform.
  5. The Provider is not responsible for inability to use the Services due to causes outside the Provider's control (the Customer's internet issues, Telegram, acquiring banks, etc.).

9. Force majeure

The parties are released from liability for non-performance or improper performance caused by force majeure: natural disasters, military actions, acts of state authorities, mass communication outages, prolonged outages of third-party services (Telegram, payment providers, cloud infrastructure) the parties cannot influence.

10. Term and termination

  1. The Contract takes effect on acceptance (payment) and stays in force until one of the parties cancels the subscription.
  2. The Customer can terminate the Contract at any time by turning off auto-renewal and / or deleting the account.
  3. The Provider can terminate the Contract unilaterally on the Customer's gross breach of this offer or the Terms of Service, with at least 7 calendar days' notice, except in cases requiring immediate action (fraud, prohibited content).

11. Governing law and dispute resolution

  1. The relationship between the parties is governed by the law of the Republic of Kazakhstan.
  2. Disputes are settled through negotiation. The response time to a claim is 30 calendar days.
  3. If a dispute cannot be settled through negotiation, it goes to the courts at the Provider's place of registration, unless the law sets a different venue for specific dispute categories (for example, for consumers).

12. Changes to the offer

The Provider can change the terms of this offer. The current version is always published at sirekees.com/legal/offer with the date of the update. We notify the Customer about material changes by email or inside the Platform at least 14 calendar days before they take effect. If the Customer does not agree, they may cancel the subscription before the changes take effect.
