Terms of Service

This English text is a convenience translation. The legally binding version is the Russian original at sirekees.com/legal/terms. Disputes are governed by Republic of Kazakhstan law.

These Terms of Service ("Terms") govern the relationship between Individual Entrepreneur «SIREKEES» (TIN 040502550481, registered at 506 Seifullin Street, office 12, Almaty, Kazakhstan; below - "Service", "we") and any person who uses the Sirekees Platform (below - "User", "you").

By signing up or using the Platform you confirm that you read, understand and accept these Terms. If you do not agree — do not use the Platform.

1. Definitions

  • Platform — the Sirekees software and infrastructure available at sirekees.com, including the API, Telegram Mini Apps, store web catalogs and related services.
  • User — an individual or legal entity that has created an account on the Platform.
  • Store — an instance of an online storefront a User creates on the Platform to take orders and / or bookings.
  • Customer — an end consumer who places an order or booking through a User's Store.
  • Content — any data (text, images, prices, schedule) the User publishes inside their Store.
  • Subscription — a paid plan that unlocks extended Platform features.

2. Subject

The Service grants the User a non-exclusive, non-transferable right to use the Platform features to create and run one or more Stores under the chosen plan.

3. Sign-up and account

  1. To use the Platform you have to create an account (email + password via Firebase Authentication).
  2. The User must provide accurate data and keep it up to date.
  3. The User is fully responsible for keeping the password safe and for every action taken under their account.
  4. If the User suspects unauthorized access, they must report it to help@sirekees.com without delay.

4. Plans and payment

  1. The Platform is provided on a subscription model. Current plans are published at sirekees.com/billing.
  2. Payments go through YooKassa (rubles) and Interkassa (tenge, US dollars). Card numbers are not passed to the Service.
  3. The subscription auto-renews until the User cancels it.
  4. Refund and termination terms are governed by the Public Offer at sirekees.com/legal/offer.

5. User obligations

  1. Follow the laws of the Republic of Kazakhstan and the country in which the User operates.
  2. Publish only content the User has legal rights to.
  3. Not use the Platform for activities that infringe third-party rights or break the law (fraud, copyright infringement, sale of prohibited goods).
  4. Hold the legal status required to take customer orders (individual entrepreneur, company, or other registration required by applicable law).
  5. Handle their own tax, accounting and other obligations linked to running their Store as a business.
  6. Get the consents needed from their Customers to process personal data.

6. Prohibited actions

The User must not:

  • Post unlawful content (drugs, weapons, counterfeit, extremism, pornography, etc.).
  • Use the Platform to send spam.
  • Take actions that disrupt the Platform (DDoS, exploiting vulnerabilities).
  • Bypass technical limits of plans or the billing system.
  • Use other people's accounts or share their own account with third parties.
  • Use Platform AI features to generate prohibited, offensive or misleading content.

7. AI features

  1. The Platform uses the xAI (Grok) language model for the AI assistant that creates and edits stores, the copywriter, analytics and the assistant chat.
  2. AI features have per-user hourly request limits to prevent abuse.
  3. The Service does not guarantee accuracy, completeness or fit-for-purpose of AI replies. The User must check generated content before publishing it.
  4. Requests to AI models are forwarded to the provider as described in the Privacy Policy.

8. User content and intellectual property

  1. The User keeps all exclusive rights to the content they publish in their Store.
  2. The User grants the Service a non-exclusive, royalty-free license to store, display and technically process this content to the extent needed to run the Platform.
  3. Exclusive rights to the Platform (source code, design, SIREKEES trademarks) belong to Individual Entrepreneur «SIREKEES». Any copying, reverse engineering or other use without written consent is prohibited.

9. Privacy

Processing of personal data of the User and their Store Customers is governed by the Privacy Policy.

10. Liability

  1. The Platform is provided "as is". The Service does not guarantee that the Platform will work without interruptions or errors.
  2. The Service makes reasonable efforts to keep availability at no less than 99% per month, excluding planned maintenance.
  3. The Service is not responsible for the quality of goods and services sold by the User through their Store, for the User's performance to their Customers, or for the correctness of the User's own Store settings (prices, stock, descriptions).
  4. The Service's total liability to the User is capped at the amount the User actually paid for the subscription in the last 12 months.
  5. The Service is not liable for lost profits, indirect damages or reputation loss.

11. Termination

  1. The User can cancel the subscription and delete their account from inside the Platform at any time.
  2. The Service can limit or stop the User's access on a gross breach of these Terms (including posting prohibited content, fraud, non-payment), with prior notice, except in cases that require immediate action.
  3. On termination, data is deleted within the time limits set in the Privacy Policy.

12. Changes to the Terms

The Service can change these Terms. The current version is published at sirekees.com/legal/terms with the date of the update. We notify the User about material changes by email or inside the Platform at least 14 days before they take effect. Continued use of the Platform after the changes take effect means acceptance of the new version.

13. Governing law and venue

The relationship between the parties is governed by the law of the Republic of Kazakhstan. Disputes go to the courts at the Service's place of registration, unless applicable law expressly says otherwise for a specific category of disputes.
